Subject: Evening Peak Load Hours Restrictions on the industries- Penalties for non compliance of instructions.

In supersession of P.R. Circular No. 14/97 dated 8.10.97 and P.R.Circular No.16/97 dated 22.12.97, P.S.E.B. is pleased to rationalize instructions on use of power during Peak Load Hours by Industrial Units, as follows:-

1) All Industrial Units having connected load of 50 KW or above shall be required to observe Peak Load Hours Restrictions on use of power.

(Earlier Restrictions where applicable only to the consumers having sanctioned connected load of 100KW & above). The consumers having sanctioned connected Load up to 49.9 KW shall be exempted from the observance of Peak Load Hours Restrictions.

2(i) M.S. connection having connected Load of Peak Load of 50 KW or above shall be allowed to use power during Peak Load Hours the extent of 10% of the connected Load for lighting, water supply purpose, Office Air-Condition equipment, Pollution Control Equipment and Aux load etc. without payment of any additional charges i.e. if a consumer is having a connected Load of 60 KW it can use 6 KW power during Peak Load Hours, without payment of additional charges.

2 (ii ) M.S. connections having connected Load of Peak Load of 50 KW or above can be allowed to use power during Peak Load Hours Restrictions above the limit specified in para-2(i) above, if they pay 100-per KW or Part thereof per month of their sanctioned connected Load above 50 KW in addition to their normal energy bill. For example, if an MS connection having sanctioned Load of 60 KW, desires to run its industry during Peak Load Hours, then it shall be required to pay Rs. 100×10 i.e. Rs.1000/- each month over & above its normal energy bill. Similarly, an MS connection having connected Load of 99.9 KW shall be required to pay 5000/- per month extra over & above their normal energy bill if it wants to run its unit during Peak Load Hours .

2(iii) Partial Peak Load Exemption in case of M.S. consumers will not be allowed i.e. if an M.S. connection wants to avail Peak Load Exemption, it will be allowed for its total connected load only. For example, if an M.S. consumers having connected load of 80 KW wants to run its factory during Peak Load Hours, the additional charges will be levied on full connected load i.e. for 80 KW, irrespective of actual load required/run by the consumer.

2( iv) The sanction to allow use of load above limit specified in para-2(i) above by M.S. Consumer during Peak Load Hours, will be granted by the senior Executive Engineer ( Operation) under intimation to Chief Engineer/SO&C, PR&C Directorate ,PSEB, Ablowal, Patiala, concerned Dy. CE/SE (Op), Billing section and concerned Enforcement Directorate .

2(v) The minimum period for which Exemption is allowed at a time in case of M.S. Consumer will be 6 months i.e. even if a consumer wants to withdraw its exemption prior to completion of 6 months, he has to pay the charges for 6 months.

3. All L.S. connections shall also be required to observe Peak Load Hours Restrictions. However, they shall be allowed to run maximum load of 10% of their sanctioned contract Demand or 50 KW which-ever is less without payment of any additional charges.

4. All L.S. connections who install or have installed Electronic Energy Motors or quality approved by PSEB, irrespective of the fact whether they are continuous process/ Essential Industry or not can be allowed to use power over & above the limits indicated in para-3 during Peak Load Hours on the following conditions.

A) Exemption of 100 KW shall be available if they pay Rs. 100/-per KW per month extra for a load of “100- eligible exemption limit as per para-3” KW over & above their normal energy bill. The minimum period for which exemption is allowed at a time will be 6 month i.e. even if a consumer wants to surrender its exemption prior to completion of 6 months, he has to pay the additional charges for 6 months.

B) Exemption above 100 KW can also be granted to the extent required by the industrial Units if they agree to pay on extra load, additional energy charges of Rs. 1.5 per K.W. per hour if their exemption does not exceed 65% of the sanctioned Contract Demand & Rs. 2.25 per Kw per hr. if exemption exceeds 65% of sanctioned contract demand.

C) (i) The Peak Load exemption to L.S. consumers under (A ) shall be granted by Dy. CE/SE/ Operation under intimation to Chief Engineer/SO&C, PR&C Directorate, PSEB, Patiala, Director/ Enforcement, Director/MMTS and concerned billing section.

(ii) The Peak Load exemption to L.S. consumers under (B) shall be granted by CE/SO&C, PR&C Directorate, PSEB, Patiala .

5. The categories of consumers mentioned at Sr. No. 2 to 4 above are not entitled to facilities available to continuous process/ Essential Industries Essential Services fed through independent Feeders (such an exemption from power cut/emergency load shedding etc.)

6. For those L.S. consumers where electronics energy meters are not installed, the existing instructions issued vide LD Circulars No. 6/86,9/90 & 20/91 will continue to be applicable, in case of consumers who are found to have violated Peak Load Instructions.

7. The status to a unit whether it is continuous process/ Essential Industries will be granted by Chief Engineer SO&C, PR&C Directorate, PSEB, Patiala .

8. The Induction and Arc Furnaces will be governed by existing instructions issued vide Commercial Circular No. CC-98/95 and P.R. Circular No. 7/97 respectively .

9. In case of Essential Services such a Hospitals, Railway Stations, Railway installations , P&T installation , Defence & Military Installation, All India Radio/T.V, Water supply & Sewerage installation, Peak Load Restrictions will not applicable.

10. The consumers covered under this circular will not be entitled for relaxations granted in the Commercial Circular no. 98/95 dated 5.12.95.

11. PENALITIES FOR VIOLATIONS :

i) All M.S. consumers having sanctioned connected Load of 50 KW and above, who have not obtained exemption of Peak Load Restrictions as per para-2 abid , if found running their units during Peak Load Hours be charged at the rate of Rs. 100/- per KW of their sanctioned connected Load minus the 10% exemption, limit on the day they are found running their Unit.

ii) All L.S. consumers who have installed Electronic Energy Meters at their premises, if are found to have violated Peak Load Restrictions, shall be charged at the following rates.

If, however any default occurs in Ist hour of the start of Restrictions period, the above rates shall be halved.

All cases of Penalties either pending or decided as per PR Circular No. 14/97 dated 8.10.97 or 40/96 dated 18.11.96, in respect of the consumers having installed Electronic meters shall be decided as per rationalized instructions covered under this circular.

12. a) The instructions contained in this circular will be applicable with immediate effect in respect of the consumers who violate Peak Load Restrictions and having installed Electronic Meter.

b) The instructions contained in this circular will be applicable from 1.6.98.

13. a) It is also reiterated that checking by MMTS of Enforcement wings does not absolve the AEs/AEEs/Xens/Sr. Xens from the responsibility of checking connections to detect Peak Load Hours Restrictions violations.

b) MMTS / Enforcement organisation may please also ensure that print outs of the Electronic Meters/TOD Meters are taken at regular intervals of every months.

14. Peak Load Restrictions Hours timing shall be observed as per timings specified in P.R. circular No. 17/97 dated 31.12.97, which are being reproduced again here:-

The above may please be got noted from all the concerned consumers well before the date implementation of these instructions .
